What Personal Information We Obtain

     Photos you uploadedUser Content. During the use of the Service, we will collect photographs that are uploaded from your devices. the content you provide, including photos, voice recordings, videos, or messages you create, upload, or share within our Service.

     Registered information. In order to register and create an account on the Service, we may collect your email address or third-party platform account information. When creating an account, we may request personal information from you, including but not limited to your name, gender, date of birth, username, password, email address, and phone number.

     Communication information.When contacting us for customer or technical support, or to express your opinions about our service via our feedback channel, we may collect the information contained in your message, such as your name, contact details, and any other personal information you choose to provide. This may include personal information, such as your email address, name, and other information provided by you when communicating with us.

     Usage Details. This encompasses information pertaining to the resources accessed and utilized by the user on or through the Service, including but not limited to IP address and logs.

     Device Information. We may obtain information regarding your mobile device and internet connection, such as the unique device identifier, operating system, browser type, and mobile network information.

     Geo-location Data. We may collect geo-location data should you choose to share it with us, to enable us to provide content sharing services.

     Cookies and Similar Technologies. We may utilize cookies to gather information regarding your interactions with our Service.

 

How We Use Personal Information We Obtain

We process your information:

                     To fulfill the Terms, and to provide you with our Services. Specially, when you use our Service to apply effects to, or generate images of, your face, you understand and agree that KaCha scans the images you upload into our services to extract your facial position, orientation, and topology ("Facial Data"). Our technology uses this Facial Data to provide the applicable services to you and to improve KaCha. For example, when you upload images into the KaCha's AI, our AI model is trained on your images, extract Facial Data based on those images and generates personalizes pictures for you. We never use this Facial Data to identify any individual person or for authentication purposes.

     At your direction, to make you can link your KaCha account and publish content to services like Facebook, Instagram, or Dropbox.

     To help you when you make customer service requests.

     To protect KaCha, our services, and our users.

     To prevent fraud, abuse, and other misconduct on KaCha.

     To help us diagnose technical and service problems and administer our website and apps.

     To conduct research and development (e.g. by training KaCha’s AI) to improve KaCha and develop future products.

     To understand how you use the Service, to create a better experience for you and other users. This includes making inferences, like what content you may be interested in, based on how you use the Service.

     To verify your identity to comply with law.

 

What permissions do we may ask you to authorize

To provide you with enhanced and efficient Services and improve your user experience, we may request your authorization to access certain device permissions. Your consent will allow us to collect permissions and corresponding information based on minimum data collection standards.

     For Android devices, we may collect camera permissions for shooting functions, request microphone access for video features, read and write external memory cards for editing photos or videos, receive notification messages, access the current network status for device network usage, advertising ID for personalized advertising content, and location access for general location information.

     For iOS devices, we may collect camera permissions for shooting functions, microphone permissions for video features, photo permissions for reading pictures in mobile phone albums for video editing, recording permissions for shooting functions, push notification permissions for receiving messages, network request permissions for requesting network data, privacy tracking permissions for collecting device advertising identifier IDFA for personalized advertising content, and location access for general location information.

You can manage and enable/disable these permissions in your device settings at any time. Disabling a permission means revoking our authorization to collect and use personal information based on that permission, which will result in the termination of the corresponding services. However, your previous authorization will remain unaffected. Please note that these permissions and corresponding information are subject to our privacy policy and applicable laws and regulations.

 

Disclosure of Personal Information to Third Parties

KaCha does not sell your information and considers it to be an important part of our relationship with you. However, we may share your Personal Data with certain third parties under the following circumstances:

     Affiliates and subsidiaries: We may share your information with our affiliates and subsidiaries as necessary to operate our services.

     Service providers: We engage third parties to provide services or handle transactions on our behalf, and they use your information as necessary for the performance of their services. In particular, to generate AI portrait photos, you need to upload one front-facing photo and ten regular selfie photos to Kacha. The photos you upload are stored on our Servers, which are hosted by Amazon Web Services. The AI portrait photos feature relies on the Stable Diffusion model. We create a copy of the Stable Diffusion model and apply technology that retrains the model using the photos you uploaded, generating image data to create and personalize your photos.

     Social media platforms: If you interact with social media widgets or features of the Services provided by social media platforms, these platforms may collect information.

     Required by law or to protect our rights: We may share your information as necessary to comply with applicable laws or to protect our legal rights or the safety of our employees, users, or other individuals.

     Corporate transactions: We may transfer your information in connection with the sale or transfer of our business or assets.

     With your consent or direction: We may share your information with third parties when you consent to or request such sharing.

In order to ensure the realization of relevant functions and the safe and stable operation of applications, we may access software development kits (“SDK”) provided by third parties to achieve relevant purposes

Security and Store

We retain your information for as long as it is necessary to provide you with the Service. Where we do not need your information in order to provide the Service to you, we retain it only for so long as we have a legitimate business purpose in keeping such information. However, there are occasions where we are likely to keep this information for 6 months (or longer if required) in accordance with our legal obligations or where it is necessary for the establishment, exercise or defence of legal claims. After you have terminated your use of our Service and the 6 months retention period has lapsed, we store your information in an aggregated and anonymised format. Non-personally identifiable information may be retained indefinitely for analytics. It is important to note that the third-party SDKs integrated into our Service will not store any user's Facial Data. We do our best to safeguard personal information during collection, processing, and retention, using commercially acceptable methods to prevent loss, theft, unauthorized access, disclosure, copying, use, or modification. However, we cannot guarantee absolute data security as no electronic transmission or storage method is entirely secure. We recommend that you choose strong passwords and take responsibility for ensuring the security of your information within our services. This includes safeguarding passwords associated with accessing your personal information and accounts, ensuring they are secure and kept confidential.

 

Children

KaCha is not intended for or directed at children under 14, and we do not knowingly collect personal information from children under the age of 14. If you are under the age of 14, please do not submit any personal information through the Services. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data on the Services without their permission. If you are aware of anyone younger than 14 using our Services, or if you have reason to believe that a child under the age of 14 has provided personal information to KaCha through the Services, please contact us at support@kacha.ai, and we will endeavor to delete that information from our databases.
